SCOPE OF APPLICATION

The following terms and conditions apply to all contractual relationships between Papa-Provokateur Gastronomie GmbH and its customers.

Any terms and conditions of the customer that deviate from the following provisions are expressly rejected. By placing an order or entering into an agreement, the customer acknowledges that the currently valid version of the terms and conditions shall be solely authoritative for the contractual relationship.

PRODUCTS

Papa-Provokateur Gastronomie GmbH offers tickets and vouchers via an online shop.

In addition, individual bookings for corporate events or birthday parties, for example, can be arranged by email or telephone.

CONCLUSION OF THE CONTRACT

a) Sale of tickets and vouchers

Tickets and vouchers can be purchased via the Bookingkit.com internet platform, which is subject to its own terms and conditions.

b) Individual agreements

Für individuell getroffene Vereinbarungen wie bspw. Firmen-Events oder Geburtstagsfeiern gelten die vorliegenden AGB.

Papa-Provokateur Gastronomie GmbH is entitled to request advance payment from the customer. If advance payment has been agreed, the contract shall only become valid once the advance payment amount has been credited to the account of Papa-Provokateur Gastronomie GmbH.

Papa-Provokateur Gastronomie GmbH reserves the right to terminate the event contract without notice if the agreed advance payment has not been received within the period specified in the contract or after a grace period to be set by Papa-Provokateur Gastronomie GmbH.

The agreed dates are binding for both parties. Papa-Provokateur Gastronomie GmbH reserves the right to rent the reserved premises to other parties after the agreed period has expired without further notice to the customer.

CANCELLATIONS

a) Tickets and vouchers

Tickets and vouchers purchased via Bookingkit cannot be exchanged or cancelled.

Changes to appointments must be requested via the email address provided (info@knutschfleckberlin.de). Confirmation of an appointment change will be decided on an individual basis depending on availability.

b) Individual bookings

Individual arrangements must be cancelled, postponed or changed by the customer at least one week in advance by email or contact form, otherwise the full price will be charged.

The following cancellation policy applies to bookings for companies or groups of more than 10 people: If cancellation occurs four weeks prior to the booking, 20 per cent of the total price is payable; two weeks prior, 50 per cent is payable; and one week prior, 100 per cent is payable.

The calculation is based on the number of persons specified at the time of conclusion of the contract.

c) Table reservations

Table reservations must be cancelled at least 24 hours in advance by email or using the contact form, otherwise a cancellation fee of €40 will be charged.

LIABILITY / COMPENSATION

Unless otherwise specified below, claims for damages by the customer are excluded. If the customer asserts claims against legal representatives and/or vicarious agents of Papa-Provokateur Gastronomie GmbH, the above exclusion of liability shall also apply in their favour.

This does not apply to claims for damages resulting from injury to life, limb or health, or claims for damages resulting from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.

Also excluded from the disclaimer is liability for damages resulting from intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.

The provisions of the Product Liability Act (ProdHaftG) remain unaffected.

WARRANTY / GUARANTEE

The statutory rights of liability for defects apply. Papa-Provokateur Gastronomie GmbH does not provide any guarantee.

FURTHER CONSUMER INFORMATION REGARDING DISTANCE SELLING CONTRACTS

The customer can find the essential characteristics of the goods or services offered, as well as the period of validity of limited-time offers, in the individual product descriptions.

Papa-Provokateur Gastronomie GmbH reserves the right to change the range and prices of the current product range at any time.

DATA PROTECTION

Photographs and videos are taken on the premises of Papa-Provokateur Gastronomie GmbH. All guests and customers agree that they may be visible in these photographs and videos. The material will be used for advertising purposes, on the website and on social media channels.

Papa-Provokateur Gastronomie GmbH processes personal customer data in compliance with the data protection provisions applicable to the contract. The data is collected, processed and used in an automated procedure to the extent necessary for the contractual relationship. The customer authorises TV-Turm GmbH to transfer this data to third parties commissioned with the execution of the contract, insofar as this is necessary to fulfil the contracts concluded.

To the complete privacy policy

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and Papa-Provokateur Gastronomie GmbH is Berlin.

NOTICE PURSUANT TO SECTION 36 OF THE CONSUMER DISPUTE RESOLUTION ACT (VSBG)

We are not legally obliged and are also not willing to participate in dispute resolution proceedings before a consumer arbitration board.
